Eileen is an experienced dual qualified litigation solicitor who has many years’ experience handling a wide range of disputes in the First Tier Tribunal, Lands Chamber, County Court, High Court and Court of Appeal

Eileen advises on all aspects of Property Litigation, both Commercial and Residential including recovery of rent and service charge arrears, forfeiture, lease renewals, dilapidations claims, Party Wall Disputes and Right to Manage Claims

Highlights:

  • Advising client landlord to appeal Lands Chamber Right to Manage Decision. The appeal was successful with the Court of Appeal unanimously holding that a Right To Manage Company can only acquire the management of a single building and not all residential buildings on the estate.
  • Acting on behalf of a Property Developer in Section 8 CPR proceedings against multiple parties for Specific Performance of Sales Contracts
  • Successfully acting for defendant landlords in a trial involving the lease of a luxury, high rent residential property where the tenant alleged breaches of the landlords repairing covenants and withheld rent and claimed damages for breaches of covenants
  • Successfully acting for the Defendant in Charity Law proceedings (High Court) concerning the purchase of a property
  • Recovery of Section 106 Town and Country Planning Act contributions on behalf of national property developers
  • Successful applications for the recovery of 100% of the Landlord Clients legal fees from the First Tier Tribunal
  • Successfully renegotiating contentious Telecom rooftop leases
  • Successfully negotiating significant premiums for client landlord in Right of Light disputes
